These Terms of Use (the "Terms") govern your use of the website at sercanaslanturkey.com (the "Site"), operated by Sercan Aslan Türkiye (the "Clinic"). By visiting or using the Site in any way, you (the "User") confirm that you have read, understood and accepted these Terms.
1. Acceptance and Scope
By accessing or using the Site in any manner, you agree to be bound by these Terms. If you do not accept these Terms, please do not use the Site.
The Site is published in thirteen (13) languages to serve international health-tourism patients. In the event of any inconsistency between language versions of these Terms, the Turkish text shall prevail.
2. Informational Nature of the Site, Not Medical Advice
All content on the Site, including treatment descriptions, hair-analysis wizard outputs, frequently asked questions and responses from the AI assistant, is provided for general informational purposes only and does not constitute medical advice, diagnosis or treatment.
Using the Site, submitting online forms, completing the hair-analysis wizard or chatting with the AI assistant does not create a doctor–patient relationship between the User and the Clinic or any physician. All treatment decisions are made only after a clinical assessment and examination carried out by the physician.
If you have a medical emergency, do not rely on the Site; contact the emergency services in your country.
3. Eligibility (18+)
The Site is intended for persons who are at least eighteen (18) years of age. By using the Site, you represent that you are at least eighteen years old and have the legal capacity to accept these Terms. Persons under eighteen must not submit forms containing personal data through the Site and must not use the AI assistant.
4. Acceptable Use
The User agrees to use the Site only for lawful purposes and in accordance with these Terms. The following are expressly prohibited:
- Providing false or misleading information in the forms, the hair-analysis wizard or the AI assistant, or sharing another person's information without that person's permission;
- Attempting to disrupt the operation of the Site, to circumvent its security measures (including the anti-bot verification on the forms) or to gain unauthorised access to the Site or connected systems;
- Accessing the Site systematically by automated means (bots, scrapers or similar) or copying Site content in bulk;
- Transmitting content that is unlawful, defamatory, threatening or infringes the rights of third parties;
- Using the Site or its content for commercial purposes without the Clinic's prior written consent.
5. AI Assistant
The live-chat service on the Site is provided by an AI-powered digital assistant. In line with Article 50 of the EU AI Act, the assistant clearly discloses that it is an AI; you may request to speak with a human consultant at any time.
The assistant's responses are for general information only; they do not constitute medical advice and may be inaccurate or incomplete. They are no substitute for a clinical assessment by the physician.
Chat conversations may be reviewed by the Clinic's consultants to ensure service quality and to respond to your enquiry. Contact details you share in the chat are stored so that we can respond to you; a short data-protection notice is displayed in the chat when contact details are first shared. 6. Intellectual Property
All content and elements of the Site, including the brand, logo, texts, images, videos, design, software and the hair-analysis wizard, belong to the Clinic or its licensors and are protected under applicable law, including Turkish Law No. 5846 on Intellectual and Artistic Works and Law No. 6769 on Industrial Property.
The User is granted a limited, non-transferable and revocable right to view the Site for personal, non-commercial purposes only. Copying, reproducing, distributing, modifying, adapting or communicating Site content to the public without the Clinic's prior written consent is prohibited.
7. Third-Party Links
The Site may contain links to third-party websites. These links are provided for convenience only; the Clinic has no control over, and accepts no responsibility for, the content, accuracy, security or privacy practices of third-party sites. When you access linked sites, their own terms of use and privacy policies apply.
8. No Guarantee of Results
The results of hair transplant, dental and aesthetic treatments vary from person to person. Nothing on the Site may be interpreted as a promise or guarantee of any particular treatment outcome. The Clinic acts in accordance with Turkish health legislation governing the promotion of health services and does not provide any guarantee of results.
Suitability for treatment, expected results and possible risks are determined individually, and only following a clinical assessment carried out by the physician.
9. Limitation of Liability
The Site is provided "as is". The Clinic does not warrant that the Site will operate without interruption or error, or that it will be entirely free of security vulnerabilities; access to the Site may be temporarily suspended for technical maintenance, updates or reasons beyond the Clinic's control.
To the maximum extent permitted by applicable law, the Clinic shall not be liable for indirect damages arising from the use of, or inability to use, the Site, from decisions taken in reliance on information on the Site, or from third-party content. This clause does not exclude the Clinic's liability for wilful misconduct or gross negligence, and it does not affect consumers' rights under mandatory law.
10. Privacy and Data Protection
Detailed information on how your personal data is processed is set out in the KVKK Privacy Notice (Aydınlatma Metni), the Privacy Policy and the Cookie Policy published on the Site. You may change your cookie preferences or withdraw your consent at any time via the "Cookie settings" link in the Site footer.
You may exercise your rights under Article 11 of the Turkish Personal Data Protection Law (KVKK) and, where applicable, Chapter III of the GDPR by contacting hello@sercanaslanturkey.com; KVKK applications are answered within thirty (30) days at the latest.
11. Changes to These Terms
The Clinic reserves the right to amend these Terms at any time, in line with changes in legislation or updates to its services. The current version, together with its effective date, is published on the Site and takes effect upon publication. Your continued use of the Site after a change constitutes acceptance of the updated Terms.
12. Governing Law, Jurisdiction and Contact
These Terms are governed by the laws of the Republic of Türkiye. Subject to consumers' rights under mandatory law, the Courts and Enforcement Offices of Istanbul shall have jurisdiction over any dispute arising out of or in connection with these Terms.
If any provision of these Terms is held invalid or unenforceable, the validity of the remaining provisions shall not be affected.
